60-year-old attacked after calling woman an 'unfit mother'

A 34-YEAR-OLD woman has faced court for attacking a 60-year-old woman who called her "an unfit mother".

Jody Diebella pleaded guilty to assault occasioning bodily harm in Ipswich Magistrates Court this week.

Police prosecutor Sergeant Brad Dick said Diebella had attacked the 60-year-old woman during a dispute on September 6 last year.

The victim was the mother of Diebella's ex-partner of two years.

Diebella had visited the 60-year-old at her Redbank Plains address to recover a mobile phone SIM card that had belonged to her.

The request for the card turned into a verbal argument where the women began insulting one another.

Defence lawyer Matthew Fairclough said there had been a series of unresolved issues between the women.

When the other woman called Diebella an "unfit mother" she reacted by punching her numerous times.

Sgt Dick said Diebella also "clawed at the victim's face" with her nails and kneed and kicked her in the head.

As a result, the victim sustained scratches and bruises to her face.

Mr Fairclough said Diebella had no history of violence and that his client been distressed at the time of the offence. He said even though Diebella was somewhat provoked, she accepted she had overreacted.

Magistrate Deborah Vasta said Diebella's attack was "absolutely abhorrent".

"I accept there was some level of provocative behaviour but no where near as much that would have warranted this sort of violent response," she said.

Diebella was fined $400 and ordered to pay $400 in compensation. No convictions were recorded.
