Mackay man found not guilty of raping partner's daughter

A MACKAY man has been found not guilty of raping his former girlfriend's school-aged daughter.

The man, who cannot be named, had pleaded not guilty to raping and indecently treating the girl in 2003.

He had also been accused of supplying her with marijuana.

After a four-day trial in the Brisbane District Court, a jury took only four hours to find the man not guilty on all charges.

The 39-year-old sobbed in the dock as the verdict was handed down on Friday afternoon.

His supporters gasped in relief from the public gallery.

It was the second time the man had faced trial for the charges after another jury failed to reach a veridct earlier this year.

This week's trial had heard the man had been in an on-again, off-again relationship with a woman he met in Mackay in 2002.

The woman and her children lived with the man in Brisbane in 2003.

Her eldest daughter went to police in 2010 with the allegations the man raped her when her mother was not home.

The trial heard the girl also told a teacher in 2003 the man had stood in her bedroom naked.

The teacher told the girl's mother who did not believe her.

The defence argued the girl lied about the allegations while the Crown submitted she was a credible witness who waited so long to tell police because she thought the man and her mother may get back together.

Justice Terence Martin discharged the man on Friday.
